Welcome to Forge Daily Labs. The terms “we,” “us,” and “our” refer to Forge Daily Labs LLC. Forge Daily Labs operates this website and online store, including the information, content, features, tools, products, and services offered through it (collectively, the “Services”).

Forge Daily Labs is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”) describe your rights and responsibilities when accessing or using our Services. By visiting, interacting with, or purchasing from our website, you agree to these Terms and our Privacy Policy. If you do not agree, you should not use the Services.

SECTION 1 — ELIGIBILITY, ACCESS AND ACCOUNTS

By using the Services, you represent that you are at least the age of majority in your state or jurisdiction of residence or that you have the permission of a parent or legal guardian where required by law.

You agree that information you provide to us, including contact, billing, payment, and shipping information, will be accurate, current, and complete.

Forge Daily Labs offers dietary supplements, nutrition products, personal-care products, and other health, wellness, fitness, and performance-related products.

We make reasonable efforts to accurately display and describe our products. Product packaging, labeling, colors, appearance, ingredients, formulations, quantities, or other characteristics may occasionally change or appear differently than shown on your device.

Product descriptions and information are provided for general informational purposes. You should always review the actual product label, ingredient list, directions, warnings, and other information provided with a product before using it.

Products and information offered by Forge Daily Labs are not intended to diagnose, treat, cure, or prevent any disease. Nothing on this website is intended to constitute medical advice or replace advice from a qualified healthcare professional.

We reserve the right to modify or discontinue products or limit quantities available for purchase at any time.

SECTION 3 — ORDERS

Placing an order constitutes an offer to purchase products from Forge Daily Labs. We reserve the right to accept, reject, limit, or cancel an order when reasonably necessary, including in cases involving suspected fraud, pricing or inventory errors, product availability, payment issues, or misuse of promotions.

Your order is not considered accepted until payment has been successfully processed and the order has been accepted for fulfillment.

Please review your order carefully before submitting it. Orders may enter fulfillment quickly, and we cannot guarantee that changes or cancellations can be made after an order has been submitted.

If an order must be changed or canceled by us, we will attempt to contact you using the information supplied with the order.

Purchases are subject to our Return and Refund Policy, available on our website.

Products purchased through our consumer storefront are intended for personal or household use unless we expressly authorize otherwise.

SECTION 4 — PRICES, PROMOTIONS AND BILLING

Prices, promotions, discounts, product availability, and offers may change without notice.

Unless otherwise stated, displayed product prices do not include applicable taxes or shipping charges. Applicable charges will be displayed during checkout before you submit your order.

Promotional codes and discounts may be subject to additional conditions, including expiration dates, eligible products, minimum purchase requirements, and restrictions on combining promotions.

We reserve the right to correct pricing or promotional errors.

You agree to provide accurate and authorized payment information and represent that you are authorized to use the payment method submitted for your purchase.

SECTION 5 — SHIPPING AND DELIVERY

Shipping and delivery times displayed by Forge Daily Labs are estimates and are not guaranteed.

Orders may be fulfilled and shipped by third-party fulfillment partners and carriers. Delays can occur because of carrier operations, weather, holidays, supply-chain disruptions, incorrect addresses, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address.

If your shipment arrives damaged, contains an incorrect product, appears materially compromised, or has another fulfillment-related problem, contact support@forgedailylabs.com as soon as reasonably possible. We will review the circumstances and work toward an appropriate resolution.

SECTION 6 — RETURNS AND REFUNDS

Returns, refunds, replacements, and cancellations are governed by our Return and Refund Policy.

Because many Forge Daily Labs products are consumable supplements or personal-care products, opened or used products may not be eligible for return for health, safety, hygiene, and product-integrity reasons.

Do not send a product back without first contacting support@forgedailylabs.com and receiving return instructions. Unauthorized returns may not be accepted.

SECTION 7 — INTELLECTUAL PROPERTY

The Forge Daily Labs website and its original content, branding, logos, graphics, photographs, designs, text, slogans, and other materials are owned by or licensed to Forge Daily Labs LLC and are protected by applicable intellectual-property laws.

You may use the Services for personal, non-commercial purposes only. Except where permitted by law, you may not reproduce, distribute, modify, republish, sell, commercially exploit, or create derivative works from our protected content without prior written permission.

“Forge Daily Labs,” associated logos, designs, and branding may not be used in a manner that falsely suggests sponsorship, endorsement, affiliation, or authorization.

Third-party trademarks and intellectual property remain the property of their respective owners.

SECTION 8 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES

Certain features of our Services may be provided by third parties. We may provide access to third-party tools or services that we do not control.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Forge Daily Labs is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Forge Daily Labs. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Forge Daily Labs, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Forge Daily Labs.

SECTION 10 — PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy, available on our website.

Because our Services are hosted by Shopify, Shopify may collect and process information relating to your access to and use of the Services as necessary to provide and improve its services.

Information may also be processed by payment processors, fulfillment providers, shipping carriers, analytics providers, and other service providers necessary to operate our business and fulfill customer orders.

SECTION 11 — REVIEWS, FEEDBACK AND USER CONTENT

If you submit reviews, photographs, comments, suggestions, testimonials, or other content (“Feedback”), you represent that you have the right to provide that content and that it does not violate the rights of another person or applicable law.

By submitting Feedback, you grant Forge Daily Labs a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and adapt the Feedback for legitimate business and promotional purposes, subject to applicable law.

You remain responsible for the accuracy and legality of content you submit.

We reserve the right to remove content that we reasonably determine is fraudulent, unlawful, abusive, misleading, infringing, obscene, or otherwise inappropriate.

SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, availability, pricing, promotions, shipping charges, transit times, or other information.

We reserve the right to correct errors, update information, or cancel affected orders when reasonably necessary, subject to applicable law.

Provisions that by their nature should survive termination will continue to apply after termination.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

EXCEPT FOR WARRANTIES THAT CANNOT LEGALLY BE EXCLUDED, FORGE DAILY LABS DISCLAIMS EXPRESS OR IMPLIED WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT ACCESS TO THE SERVICES WILL ALWAYS BE UNINTERRUPTED, SECURE, TIMELY, OR ERROR-FREE.

Nothing in these Terms excludes any warranty, right, or remedy that cannot legally be excluded under applicable law.

SECTION 16 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, FORGE DAILY LABS LLC AND ITS AFFILIATES, OWNERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

SECTION 17 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Forge Daily Labs LLC and its affiliates, owners, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable costs arising from your material violation of these Terms, violation of applicable law, or infringement of another party’s rights.

SECTION 18 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law and severed to the extent necessary. The remaining provisions will remain in effect.

SECTION 19 — WAIVER AND ENTIRE AGREEMENT

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision.

These Terms, together with policies incorporated or referenced herein, constitute the agreement governing your use of the Services and supersede prior communications relating to that subject matter.

SECTION 20 — ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations as permitted by applicable law, including in connection with a restructuring, sale, merger, or transfer of the business.

SECTION 21 — GOVERNING LAW

These Terms and your use of the Services are governed by the laws applicable in the State of Ohio, United States, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.

Any dispute will be subject to the jurisdiction of an appropriate court having jurisdiction in Ohio, except where applicable law provides otherwise.

We may update these Terms periodically to reflect changes to our Services, products, business practices, or legal requirements.

The current version will be posted on this page with an updated effective date. Material changes will be communicated where required by applicable law.

Your continued use of the Services following an effective update constitutes acceptance of the revised Terms to the extent permitted by law.
